
The Board of Directors of the Congolese Lottery Management Company (COGELO- S.A), held Friday 18 September 2020 at the headquarters of the Ministry of Finance and Budget in Brazzaville, has appointed Guy Roger Moigni, the new Managing Director of the company.
The new Managing Director replaces Nestor Tchissambot Makosso in this position. According to the Chairman of the Board of Directors, Guy Wilfid Ewolo, Administrative and Legal Adviser to the Minister of Finance and Budget Calixte Nganongo, "the decision to dismiss Nestor Tchissambot Makosso follows the critical situation that the company is going through since his resumption of duties in 2019. This situation is characterised by a navigation within sight of the company (notably the absence of a budget balance sheet for the company for the year 2019 and the absence of a budget project). The consequence of this situation can be seen in four months of unpaid wages to the company's employees and agents, a debt of unpaid social and employer contributions to the National Social Security Fund (CNSS) and another debt to the Tax Administration, thus setting aside the Plan for the settlement of these debts".
The time has therefore come to reorganise the company, in accordance with the provisions of the Treaty of the Organisation for the Harmonisation of Business Law in Africa (OHADA). Among these provisions, the power to appoint the Managing Director of a company devolved to the Board of Directors, and no longer by Presidential Decree or Council of Ministers.
It should be noted that this session of the Board of Directors took place in the presence of two judicial officers and a notary.
